Pelo regulamento do setor, os chamados operadores aeroagr\u00edcolas privados (ou TPPs, que s\u00e3o os fazendeiros, empresas de produ\u00e7\u00e3o ou cooperativas que t\u00eam seus pr\u00f3prios avi\u00f5es agr\u00edcolas) s\u00f3 podem realizar esse tipo de servi\u00e7o em suas \u00e1reas pr\u00f3prias ou arrendadas para sua produ\u00e7\u00e3o. Conforme o presidente do Sindag, Thiago Magalh\u00e3es Silva, al\u00e9m de concorr\u00eancia desleal com as empresas (que cumprem requisitos extras para operar) essa atitude tomada por alguns produtores representa um risco para a seguran\u00e7a ambiental e operacional.<\/span><\/p>\n<p><a href=\"https:\/\/sindag.org.br\/site-antigo\/wp-content\/uploads\/2021\/11\/Of.-034-2021-Ministra-Agricultura-1.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\"><em><span style=\"font-family: 'book antiqua', palatino, serif;\">Confira <strong>AQUI<\/strong> a \u00edntegra do of\u00edcio 34\/21 do Sindag<\/span><\/em><\/span><\/a><\/p>\n<p><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\">As opera\u00e7\u00f5es clandestinas ferem diretamente o C\u00f3digo Brasileiro de Aeron\u00e1utica (Lei n\u00ba 7565\/1986), o Regulamento Brasileiro da Avia\u00e7\u00e3o Civil (RBAC) 137, a pr\u00f3pria Instru\u00e7\u00e3o Normativa (IN) 02\/2008 do Mapa, que regulamenta as opera\u00e7\u00f5es aeroagr\u00edcolas, al\u00e9m dos dois decretos federais que tratam diretamente do setor (Decreto-Lei 917\/69 e Decreto n\u00ba 8671565\/81). Al\u00e9m disso, as opera\u00e7\u00f5es clandestinas tamb\u00e9m se enquadram em crime ambiental, j\u00e1 que a Lei 9.605\/1998, que trata desta mat\u00e9ria, considera como tal \u201cfazer funcionar, em qualquer parte do territ\u00f3rio nacional, servi\u00e7os potencialmente poluidores, sem licen\u00e7a ou autoriza\u00e7\u00e3o dos \u00f3rg\u00e3os ambientais competentes, ou contrariando as normas legais e regulamentares pertinentes.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #000000;\"><strong>EXIG\u00caNCIAS<\/strong><\/span><\/p>\n<p><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\">Tanto as empresas aeroagr\u00edcolas \u2013 <em>classificadas Servi\u00e7o A\u00e9rea Especializado (SAE)<\/em> \u2013 quanto os operadores TPP precisam ser registrados no Mapa e na Ag\u00eancia Nacional de Avia\u00e7\u00e3o Civil (Anac). Ambas tamb\u00e9m s\u00e3o obrigadas a terem em seu quadro pilotos especializados, engenheiro agr\u00f4nomo respons\u00e1vel (como coordenador das opera\u00e7\u00f5es) e um t\u00e9cnico agr\u00edcola com especializa\u00e7\u00e3o em opera\u00e7\u00f5es a\u00e9reas em cada miss\u00e3o em campo. Al\u00e9m de p\u00e1tio de descontamina\u00e7\u00e3o e outras exig\u00eancias. Por\u00e9m as empresas aeroagr\u00edcolas ainda possuem exig\u00eancias complementares como o Certificado de Operador A\u00e9reo (Coa), emitido pela Anac, entre outros requisitos.<\/span><\/p>\n<p><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\">Para completar, as empresas filiadas ao Sindag (<em>que abrange atualmente mais de 80% do setor<\/em>) tamb\u00e9m s\u00e3o atendidas por projetos de melhoria cont\u00ednua de seu pessoal t\u00e9cnico e de qualifica\u00e7\u00e3o de seus gestores \u2013 <em>focados na conformidade t\u00e9cnica e legal, efici\u00eancia e seguran\u00e7a<\/em>. Conforme Magalh\u00e3es, o of\u00edcio foi enviado ao Mapa na \u00faltima quinta-feira (28), por ser este o \u00f3rg\u00e3o diretamente respons\u00e1vel por coordenar e fiscalizar o setor aeroagr\u00edcola no Pa\u00eds. A atitude foi tomada devido ao n\u00famero crescente de reclama\u00e7\u00f5es que chegam \u00e0 entidade aeroagr\u00edcola, de todo o Pa\u00eds, relatando casos de fazendeiros que contratam servi\u00e7os de aplica\u00e7\u00f5es feitas por aeronaves clandestinas \u2013 n\u00e3o homologadas para servi\u00e7o a\u00e9reo especializado.<\/span><\/p>\n<p><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\">Segundo o \u00faltimo levantamento do Sindag sobre a frota aeroagr\u00edcola nacional, realizado no in\u00edcio do ano, das 2.352 aeronaves agr\u00edcolas do Pa\u00eds, 1.459 (62%) est\u00e3o com as empresas de avia\u00e7\u00e3o agr\u00edcola \u2013 <em>os chamados operadores de Servi\u00e7o A\u00e9reo Especializado (Sae)<\/em>. As outras 869 aeronaves (37%) pertencem a operadores privados (categoria TPP, segundo a Anac). By agav regulation in the country, the so-called private ag aviation operators (or TPPs, which are farmers, agricultural companies or cooperatives that have their own agricultural aircraft) can only perform this type of service in their own crops. According to the president of Sindag, Thiago Magalh\u00e3es Silva, in addition to unfair competition with companies (which meet extra requirements to operate), this attitude taken by some producers represents a risk to environmental and operational safety.<\/span><\/em><\/p>\n<p><em><span style=\"font-family: arial, helvetica, sans-serif;\">Clandestine operations directly violate the Brazilian Aeronautical Code (Law No. 7565\/1986), the Brazilian Civil Aviation Regulation (RBAC) 137, the Normative Instruction (IN) 02\/2008 of the Ministry, which regulates agricultural aviation operations, in addition to two federal decrees dealing directly with the sector (Decree-Law 917\/69 and Decree No. 8671565\/81). Besides, ag aviation services from farmers to farmers are an environmental crime, since Law 9,605\/1998, which deals with this matter, considers as such &#8220;to make potentially polluting services work in any part of the national territory, without a license or authorization from the agencies competent environmental authorities, or contrary to the relevant legal and regulatory standards.\u201d<\/span><\/em><\/p>\n<p><em><span style=\"font-family: arial, helvetica, sans-serif;\">REQUIREMENTS<\/span><\/em><\/p>\n<p><em><span style=\"font-family: arial, helvetica, sans-serif;\">Both the ag aviation companies \u2013 classified as Specialized Air Service (SAE) \u2013 and the TPP operators must be registered in the MAPA and in the National Civil Aviation Agency (ANAC). Both are also required to have on their staff specialized pilots, a responsible agronomist (as operations coordinator) and an agricultural technician specializing in air operations in each field mission. In addition to aircraft washing and effluent treatment system and other requirements. However, the ag aviation companies still have additional requirements such as the Air Operator Certificate (COA), issued by ANAC, among other requirements.<\/span><\/em><\/p>\n<p><em><span style=\"font-family: arial, helvetica, sans-serif;\">To complete, the companies affiliated to SINDAG (which currently cover more than 80% of the sector) are also served by projects for the continuous improvement of their technical staff and qualification of their managers \u2013 focused on technical and legal compliance, efficiency, and safety. According to Magalh\u00e3es, the letter was sent to MAPA last Thursday (28), as this is the body directly responsible for coordinating and supervising the ag aviation in the country. The attitude was taken due to the growing number of complaints that reach the SINDAG, from all over the country, reporting cases of farmers who hire application services made by clandestine aircraft \u2013 not approved for SAE.<\/span><\/em><\/p>\n<p><em><span style=\"font-family: arial, helvetica, sans-serif;\">According to the latest SINDAG survey on the national ag aviation fleet, carried out at the beginning of the year, of the 2,352 agricultural aircrafts in the country, 1,459 (62%) are with agricultural aviation companies \u2013 SAE operators. The other 869 aircrafts (37%) belong to private operators (TPPs, according ANAC).
